Governor Issues a Statement Regarding an Intermediate Court of Appeals in West Virginia
3/9/2011
CHARLESTON, W.Va.-Gov. Earl Ray Tomblin issued the following statement concerning Senate Bill 307, which calls for the establishment of an intermediate court of appeals on or before January 1, 2013. The bill, which if passed by both houses would guarantee a right of appeal, now is in the House of Delegates.
"When our Supreme Court of Appeals overhauled its rules of appellate procedure, it was a positive step in the right direction. I applaud the Court for its diligence and its determination. Our Court and our circuit courts are filled with hardworking, dedicated judges. That being said, West Virginia is in the minority of states that do not have an automatic right of appeal, and I think that should change. Senate Bill 307 does a very good job of minimizing costs while assuring a guaranteed right of appeal," Gov. Tomblin said. "Now, I call upon members of the House of Delegates to pass this bill and allow the citizens of our state a guaranteed right to access the appellate process in the judicial branch."
