Gov. Earl Ray Tomblin today released the following statement regarding the rules of the State Senate:
“As was required of me, this afternoon, I filed a response brief with the Supreme Court of Appeals of West Virginia concerning litigation involving when a new election for Governor is to occur in this State. As I have indicated before, there appears to be a consensus that our current statutes provide for the new election in 2012. Moreover, in my view, the determination of when an election should be held lies with the people, as expressed through the Legislature, as an entirebody. Thus, if there is an overwhelming sentiment for an election, I would be happy to workwiththe Legislature to accomplish that goal and arrange for an election prior to 2012.
“Based on advice provided to me, documents filed on my behalf this afternoon in the Supreme Court assert the provisions of West Virginia Code calling for an election in 2012 are in fact constitutional. Therefore, I have requested the Court deny the relief sought by various parties in the case.
“I have an abiding faith in our Supreme Court of Appeals and I know our justices will make a decision that is firmly based on the law.”
