Raleigh County Woman Pleads Guilty to Workers Compensation Insurance Fraud

CHARLESTON, WV - West Virginia Insurance Commissioner, Jane L. Cline, announced today along with Inspector General, Gary L. Griffith, that a Raleigh County woman, Angel M. Delung, age 34, of Shady Springs, WV, who was indicted on one felony count of "wrongfully seeking workers compensation" and on one felony count of "obtaining goods by false pretenses" by a Raleigh County Grand Jury on May 15, 2007, plead guilty late last month to the second count on the indictment and guilty to a reduced charge on the first count of wrongfully seeking workers compensation. Ms. Delung fraudulently obtained workers compensation benefits exceeding $3,800.00 by filing a false claim against her employer at the time, Beaver Creek Antiques, LLC. Upon the entering of the pleas, Ms. Delung was immediately sentenced to a term from one (1) year to no more than ten (10) years in prison on the second count of the indictment.  On the reduced charge of wrongfully seeking workers compensation, Ms. Delung was sentenced to a term of one (1) year in a regional jail and fined $2,500.00; both sentences are to run concurrently.  The WV Offices of the Insurance Commissioner's Fraud Unit worked in conjunction with the Raleigh County Prosecutor's office to obtain a conviction in this matter.

Commissioner Cline stated, "This type of fraud continues to raise the cost of doing business in the state for employers and we have to be vigilant in investigating and prosecuting these frauds against employers in order to encourage business to locate and stay in the state."
